2. Terms and legal bases<\/h2>\n

2.1 Terms<\/h3>\n

Data subject:<\/strong> Natural person about whom we process personal data.<\/p>\n

Personal data:<\/strong> All<\/em> information relating to an identified or identifiable natural person.<\/p>\n

Sensitive personal data:<\/strong> Data on trade union, political, religious or philosophical views and activities, data on health, the intimate sphere or membership of an ethnic group or race, genetic data, biometric data that uniquely identify a natural person, data on criminal and administrative sanctions or prosecutions, and data on social assistance measures.<\/p>\n

Processing:<\/strong> Any<\/em> handling of personal data, irrespective<\/em> of the means and procedures applied, for example the retrieval, comparison, adaptation, archiving, storage, reading, disclosure, obtaining, recording, collection, deletion, disclosure, arrangement, organisation, saving, alteration, dissemination, linking, destruction and use of personal data.<\/p>\n

2.2 Legal bases<\/h3>\n

We process personal data in accordance with Swiss law, in particular the Federal Act on Data Protection<\/a> (Data Protection Act, FADP) and the Ordinance on Data Protection<\/a> (Data Protection Ordinance, DPO).<\/p>\n

3. Nature, scope and purpose of the processing of personal data<\/h2>\n

We process those personal data that are necessary<\/em> in order to carry out our activities and operations in a durable, user-friendly, secure and reliable manner. The processed personal data may in particular fall into the categories of browser and device data, content data, communi­cation data, meta­data, usage data, master data including inventory and contact data, location data, transaction data, contract data and payment data. The personal data may furthermore constitute sensitive personal data.<\/p>\n

We also process personal data that we receive from third parties, obtain from publicly accessible sources or collect in the course of our activities and operations, provided that such processing is permissible.<\/p>\n

Where necessary, we process personal data with the consent of the data subjects. In many cases, we may process personal data without consent, for example in order to comply with legal obligations or to safeguard overriding interests. We may also ask data subjects for their consent even where their consent is not required.<\/p>\n

We process personal data for the period<\/em> that is necessary for the respective purpose. We anonymise or delete personal data in particular depending on statutory retention periods and limitation periods.<\/p>\n

4. Auto­mation and Artificial Intelli­gence (AI)<\/h2>\n

We may process personal data in an automated manner or use Artificial Intelli­gence for the processing of personal data.<\/p>\n

We may use profiling in order to evaluate certain personal aspects relating to data subjects in an automated manner. Profiling serves, for example, to analyse or predict interests, behaviour or personal preferences.<\/p>\n

We provide information in individual cases about decisions that are based exclusively on automated processing of personal data and that entail a legal consequence for the data subjects or significantly affect them (automated individual decisions).<\/p>\n

5. Disclosure of personal data<\/h2>\n

We may disclose personal data to third parties<\/em>, have them processed by third parties or process them jointly with third parties. Such third parties may, for example, be specialised providers whose services we use. Such third parties may in turn disclose personal data to third parties.<\/p>\n

In the course of our activities and operations, we may in particular disclose personal data to banks and other financial service providers, authorities, educational and research institutions, consultants and lawyers, accounting and fiduciary service providers, debt collection companies, interest groups, IT service providers, cooperation partners, credit and business information agencies, logistics and shipping companies, marketing and advertising agencies, media, parent, sister and subsidiary companies, organisations and associations, social institutions, tele­communications companies, insurers and payment service providers.<\/p>\n

6. Communication<\/h2>\n

We process personal data in order to be able to communicate with individuals as well as with authorities, organisations and companies. In doing so, we process in particular data that a data subject transmits to us when contacting us, for example by postal mail or e-mail. We may store such data in an address book or with comparable tools.<\/p>\n

Third parties who transmit data about other persons to us are legally obliged to ensure the data protection of these data subjects independently. In particular, they must guarantee that they are permitted to transmit such data, and they must also ensure the accuracy of the transmitted data.<\/p>\n

We use selected services from suitable providers in order to enable and improve communi­cation with individuals and other communication partners. With such services, we may also manage and otherwise process the data of the data subjects beyond direct communi­cation, for example in connection with orders, services, projects and resource planning.<\/p>\n

7. Data security<\/h2>\n

We take appropriate technical and organisational measures to ensure a level of data security appropriate to the respective risk. With our measures, we ensure in particular the confidentiality, availability, traceability and integrity of the processed personal data, without, however, being able to guarantee absolute data security.<\/p>\n

Access to our website and our other digital presence takes place by means of transport encryption (SSL \/ TLS<\/a>, in particular with the Hypertext Transfer Protocol Secure, abbreviated HTTPS<\/a>). Most browsers warn before visiting a website without transport encryption.<\/p>\n

Our digital communication is subject \u2013 as is generally<\/em> all digital communication \u2013 to mass surveillance without cause or suspicion by security authorities in Switzerland, in the rest of Europe, in the United States of America (USA) and in other countries. We cannot exert any direct influence on the corresponding processing of personal data by intelligence services, police authorities and other security authorities. Nor can we rule out that a data subject is subject to targeted surveillance.<\/p>\n

8. Personal data abroad<\/h2>\n

We generally<\/em> process personal data in Switzerland. However, we may also disclose or export personal data to other countries, in particular in order to process them there or have them processed there.<\/p>\n

We may disclose personal data to all countries on Earth<\/a> and elsewhere in the universe<\/a>, provided that the law there ensures an adequate level of data protection in accordance with a decision of the Swiss Federal Council<\/a>.<\/p>\n

We may disclose personal data to countries whose law does not ensure an adequate level of data protection, provided that suitable data protection is ensured for other reasons, in particular on the basis of standard data protection clauses or with other suitable safeguards. Exceptionally, we may export personal data to countries without adequate or suitable data protection if the special data protection requirements for doing so are met, for example the express consent of the data subjects or a direct connection with the conclusion or performance of a contract. We are happy to provide data subjects with information about any safeguards upon request, or to supply a copy of such safeguards.<\/p>\n
